These terms and conditions (the "Terms") govern the use of the My Concierge platform and the booking of services provided by independent providers in Saint-Barthélemy. By booking through the platform, the client accepts these Terms in full.
1. Purpose and role of the platform
My Concierge is a platform that connects (as a technical intermediary) clients wishing to book in-home services with verified independent providers. My Concierge does not perform the services itself and does not act as the providers' employer.
The platform facilitates booking, secure payment and communication between the parties. Responsibility for the proper delivery of a service lies with the provider who performs it.
2. Booking
Any booking made through the platform constitutes a firm order once payment is confirmed. The client receives an email confirmation summarising the service, date, location and amount.
The client undertakes to provide accurate information (identity, contact details, service address) and to ensure access to the agreed location at the scheduled time.
3. Pricing and payment
Prices are shown in euros (EUR), inclusive of any applicable taxes. The displayed price includes the service as well as the platform's service fees.
Payment is made online at the time of booking through our payment provider Stripe. No bank card details are stored by My Concierge.
Where applicable, cashback may be paid to the owner of the villa that referred the booking, subject to the terms of the partner programme in force.
4. Cancellation and refund
The applicable cancellation terms are specified at the time of booking. Unless otherwise stated, a cancellation made sufficiently in advance entitles the client to a full refund. After that deadline, or if the client is absent at the appointment, no refund is due.
If the provider cancels or is unable to deliver the service, the client is fully refunded or offered a new date.
5. Obligations of the parties
The provider undertakes to deliver the service professionally, in accordance with the standards, hygiene and safety rules applicable to their activity.
The client undertakes to welcome the provider in decent and safe conditions and to treat the provider with respect.
6. Liability
As My Concierge acts as an intermediary, it cannot be held liable for the service itself, which is the sole responsibility of the independent provider.
My Concierge takes reasonable steps to ensure the availability and security of the platform, without guaranteeing uninterrupted access.
7. Personal data
The processing of clients' personal data is described in the Privacy Policy, accessible from the site footer.
8. Governing law and disputes
These Terms are governed by French law. Any dispute relating to their interpretation or performance will be submitted to the competent courts, after seeking an amicable solution.
In accordance with applicable regulations, the client may resort to consumer mediation in the event of an unresolved dispute.
